Terms of Service

1. Eligibility

You must be at least 18 years old and legally able to enter into these Terms. You may not use the Service if you are located in, or are a resident of, a jurisdiction where the Service or trading digital assets is prohibited, or if you are subject to sanctions.

You are responsible for complying with the laws that apply to you, including tax obligations arising from your use of the Service.

2. What opalz.fun is

opalz.fun is a non-custodial interface for launching and trading memecoins on the Solana blockchain. When you launch a token, the Service mints it, publishes a generated website for it and opens trading on a bonding curve. A fee is taken on each trade and held for that token to pay for a decentralized exchange listing and visibility boosts, in that order, after which remaining fees are routed to the wallets the creator designates as bag workers.

opalz.fun does not hold your funds or keys. Transactions are signed by you in your own wallet and executed on the Solana network, which we do not control.

3. Memecoins only

The Service is intended solely for memecoins: tokens created for entertainment, social and cultural purposes whose value is driven by market demand and speculation, not by anyone's efforts or by any enterprise. No one is working to make these tokens valuable.

You may not use the Service to launch or promote a token that represents, or is marketed as, an investment, a security, a share in profits, a claim on any business or asset, or a right to anyone's work. We may remove such tokens from the Service without notice.

4. Fees

A 1% fee is charged on each buy and sell executed through the Service. Fees are attributed to the token traded and are spent only on that token's milestones and, once those are paid, on distributions to its bag workers. The current thresholds are published in the documentation and on each token page. We may change the fee rate or thresholds for future launches; changes do not apply retroactively to fees already collected.

Solana network fees are separate, are set by the network and are paid by you.

5. Your content and generated websites

You are responsible for the names, tickers, images, descriptions and links you submit. You represent that you have the rights to use them and that they do not infringe anyone's rights, impersonate any person or brand, or contain unlawful, hateful or sexually explicit material.

You grant opalz.fun a worldwide, non-exclusive, royalty-free licence to host, display, reproduce and adapt your content in order to operate the Service, including generating and publishing the token website and social previews.

Generated websites are produced automatically from your content. We do not review them before publication and may remove or alter them at any time.

6. Prohibited conduct

You agree not to:

• Manipulate markets, including wash trading, spoofing or coordinated pump-and-dump schemes.
• Impersonate any person, project or brand, or launch tokens using names or marks you do not own.
• Use bots or scripts to abuse the Service, circumvent rate limits or scrape it at scale.
• Launch tokens that are securities, that promise returns, or that fund unlawful activity.
• Interfere with the Service, its infrastructure or other users.

7. Risks and no advice

Digital assets are extremely volatile and may lose all value. Memecoins in particular may go to zero at any time and may not carry securities-law or other regulatory protections. Liquidity may be thin and you may be unable to sell.

Nothing on the Service is financial, investment, legal or tax advice. Market data, prices and statistics are provided as-is from third-party sources and may be delayed or inaccurate.

Blockchain transactions are irreversible. We cannot recover funds sent to the wrong address or lost due to wallet compromise.

8. Disclaimers and limitation of liability

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not guarantee that the Service will be uninterrupted, secure or error-free, or that any milestone will be reached.

To the fullest extent permitted by law, opalz.fun and its affiliates, officers, employees and contractors will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, tokens or data, arising from your use of the Service. Our total liability for any claim will not exceed the greater of USD 100 or the fees you paid to us in the twelve months before the claim.

9. Suspension and termination

We may suspend or terminate your access to the Service, remove content or delist tokens at any time if we believe you have violated these Terms or the law, or to protect the Service and its users. Tokens already minted on Solana continue to exist on-chain regardless of their status on opalz.fun.

10. Changes

We may update these Terms from time to time. The date at the top shows when they last changed. Continued use of the Service after a change means you accept the updated Terms.

11. Governing law and disputes

These Terms are governed by the laws of the jurisdiction in which opalz.fun is established, without regard to conflict-of-law rules. Any dispute will be resolved in the courts of that jurisdiction, unless applicable law gives you the right to bring a claim elsewhere.
